Carrying out of inspections on a complaint made by an employee on termination of his employment and on an application submitted by an employer to obtain permission for termination of employment of an employee


Qualifications needed to submit an application under Termination of employment of workmen (special provisions) (Amendment) Act No 45 of 1971,

  • Should be an employee engaged in an employment covered by below acts.
  • Shop and office employees Act
  • Wages boards ordinance (Employment in any trade Gazette under section 6.2 of this ordinance)
  • Factories ordinance,
  • Should have at least 15 employees in the institution served
  • At any period during 06 months on or before the date on which employment of the employee terminated
  • Employer should have terminated the employment of the employee. A complaint cannot be made in respect of an approved termination or a risk of termination in future.

Below mentioned employees are not allowed to seek relief under this Act.

  • Resigned employees
  • Employees served under fixed term contract of employment and terminated the employment at the end of the contract period.
  • Employees retired upon reaching the retirement age mentioned in the contract of employment.
  • Employees dismissed from employment as a disciplinary punishment.
  • Employees engaged in Government corporations, Statutory boards, statutory authorities, institutions took over by Government, Provincial councils, Local authorities and Cooperative societies.

Places where application form could be obtained:-

No specific application. In the event of making, a complaint below facts should be included to it.

  • Full name of the employee
  • Permanent Address
  • Appointment date
  • Designation
  • Date of birth of employee
  • EPF Number

In addition to the above facts, the date of termination of employment, reason to terminate employment, names and addresses of the director/owner/share holder of the institution should be included.

  • Documents to confirm the termination of employment
  • If for calculation of compensation, pay sheet of the last month
  • National Identity Card Number
  • Salary drawn when terminate employment (If received allowances in addition to basic salary, please mention basic salary and other allowances separately)
  • Correct name of the institution served
  • Address of the institution served (If possible, please submit a certified copy or photocopy of Form No 01 or Form No 20 of company registration)
  • Retirement age of the institution
  • Total number of employees in the institution
  • Manufacturing nature of the institution
  • Contact Numbers
