Giving instructions on payment of gratuity and taking action on complaints on gratuity

Eligibility

Employees who fulfill the qualifications in the payment of Gratuity Act No 12 of 1983, exclusive of domestic servants, personal chauffeurs, employees entitled to a pension under any non-contributory pension scheme, Government Employees, employees in Local Authorities and employees under Co-operative commission.

To be entitled to Gratuity benefits,

The particular employee should have been employed in an institution where employing 15 or more employees during the period of 12 months preceding the date of terminating or terminated the employment of the employee.

Should have completed continuous period of service of 5 years.
Method of submitting application
Places where application form could be obtained:-
No application. In the event of default of payment of gratuity, a complaint can be submitted to the Labour office in the area where the institution served located.

Time to submit application:-
Gratuity should be paid to an employee by an employer during 01 month from the date of terminated the employment of an employee. A complaint can be made if not paid gratuity during that period.
